Is it right to fine the Consultant if a candidate leaves the company before completing 3 months?

Sometimes it happens that once a candidate is hired with help of an Executive Search Consultant, if a candidate leaves the job before completing 3 months - the consultant is asked for a 100% refund or a replacement.

I feel that instead of this, there should be a clause in candidate's appointment letter that if he/she leaves the company before completing 3 months - he/she is legally bound to pay so and so amount. This looks more logical and practical to me.
