Is it right to fine the Consultant if a candidate leaves the company before completing 3 months?

Sometimes it happens that once a candidate is hired with help of an Executive Search Consultant, if a candidate leaves the job before completing 3 months - the consultant is asked for a 100% refund or a replacement.

I feel that instead of this, there should be a clause in candidate's appointment letter that if he/she leaves the company before completing 3 months - he/she is legally bound to pay so and so amount. This looks more logical and practical to me.

  1. Janak has a valid point. Because of the market competition week candidates are tempted to switch jobs as soon as new opportunities arise.
    Candidates opting for the top management positions must undertake the responsibility and commit themselves for a minimum period of one year in the selected job. Even manpower consultants or companies recommending candidates must take such assurance from them before recommending their names. If these candidates leave the job before specified time other then the causes of illness, they should pay the penulty. Man power recruiting agencies should have database of black listed cadidates.
